Faking a disability to gain benefits is a misdemeanor
Idaho Code §18-5811A (amended 2019)
While Idaho has no ESA documentation law, Idaho Code §18-5811A makes it a misdemeanor (up to 6 months jail and a $1,000 fine) for a person who is not disabled to use an assistance device, assistance animal, or service dog in an attempt to gain treatment or benefits as an individual with a disability — a caution against claiming an ESA you don't legitimately qualify for. It is a fraud penalty, not a letter requirement.
