How Arizona treats ESA letters

Before you pay anyone for an ESA letter in Arizona, know what the state itself requires. The details below come straight from the statute book, in plain English.

Arizona's renter-facing ESA letter requirements remain the federal HUD baseline -- there is no 30-day relationship rule and no mandatory state documentation form; a 2025 law (HB 2068, Laws 2025, ch. 191, signed May 13, 2025) instead wrote 'assistance animal' into the Arizona Fair Housing Act and added A.R.S. 41-1491.38, which shields landlords from liability for injuries caused by an animal they approve as an accommodation, making approvals lower-risk for them. Ignore sources citing 'A.R.S. 33-1319' for ESA rules -- that section is actually Arizona's bedbug statute, and the documentation provisions in early drafts of HB 2068 were dropped before passage. Housing discrimination complaints go to the Arizona Attorney General's Civil Rights Division, which enforces the state Fair Housing Act (A.R.S. 41-1491 et seq.), or to HUD.

2025 assistance-animal amendments to the Arizona Fair Housing Act (HB 2068)

A.R.S. §§ 41-1491, 41-1491.38 (HB 2068, Laws 2025, ch. 191, approved May 13, 2025)

Effective 2025, Arizona statutorily defines an 'assistance animal' as a trained or untrained animal that works, provides assistance, performs tasks, or provides therapeutic or emotional support for a person with a disability (ESAs included), defines 'service animal' as a trained dog or miniature horse, and grants landlords immunity from liability for injuries or damages caused by an assistance or service animal allowed as a reasonable accommodation. It does not add any documentation burden for renters -- HUD's standard still governs what you must provide.

Civil penalty for service-animal misrepresentation (public places)

A.R.S. § 11-1024

Fraudulently misrepresenting an animal as a service animal or service animal in training to a public place carries a civil penalty of up to $250 per violation. This targets public-access fraud, not housing letters, but it is why a legitimate ESA letter should never claim your animal is a service animal.

Every FetchMyESA letter in Arizona comes from a clinician with an active AZ license, after a real evaluation. That is the standard the law expects, and it is the only kind of letter we issue.

Arizona questions, straight answers

Do online ESA letters actually work in Arizona?

Yes. The law cares about who signed it and whether they evaluated you, not whether the appointment happened over video. Every FetchMyESA letter comes from a AZ-licensed clinician after a live evaluation.
